In-context Links? No Comment!

A few days ago, I wrote about the ethics of using Infolinks in comments. At the time, I did not realize how subtle and sneaky these in-context ad link systems could be (not just Infolinks, but Kontera and presumably others, as well). Sure, Infolinks shoves all the legal responsibility onto the blogger – it’s right there, in the FAQ, if anyone bothers to read it:

Can I use Infolinks with user generated or 3rd party content? Yes, just like any content you have in your website. Please notice that it is your responsibility to obtain legal rights to use any such content.
